Phúc đáp công văn số 02.04/2020/CV-TL ngày 16/4/2020 của Doanh nghiệp, Cục Hải quan TP. Hồ Chí Minh trả lời như sau:
Căn cứ khoản 4 Điều 3 Nghị định 31/2018/NĐ-CP ngày 08/03/2018 của Chính phủ, quy định: "4. Giấy chứng nhận xuất xứ hàng hóa là văn bản hoặc các hình thức có giá trị pháp lý tương đương do cơ quan, tổ chức thuộc nước, nhóm nước, hoặc vùng lãnh thổ xuất khẩu hàng hóa cấp dựa trên quy định và yêu cầu liên quan về xuất xứ, chỉ rõ nguồn gốc xuất xứ của hàng hóa đó.”
Như vậy, Giấy chứng nhận xuất xứ hàng hóa (C/O) là văn bản do cơ quan, tổ chức có thẩm quyền nước xuất khẩu hàng hóa cấp; Do đó, trường hợp Doanh nghiệp đề nghị hướng dẫn thể hiện tiêu chí xuất xứ trên C/O mẫu E không thuộc thẩm quyền của cơ quan hải quan nước nhập khẩu.
Cục Hải quan TP. Hồ Chí Minh trả lời để Doanh nghiệp biết./.

Công ty chung tôi có vấn đề xin đuọc trình bày như sau:
Trong thòi gian qua, Công ty chúng tôi có mua hàng Rong biển khô nấu canh của
Công ty Guangzhou Fu De Lu Trading Co.,LTD, sản phẩm có chứng từ C/O form E kèm theo.
Sảnphẩm có tên là : SEASONING LAVER
Trước năm 2020, sản phẩm được nhập khẩu vói mã HS: 121221 vói tiêu chí xuât xứ là WO. Từ đầu năm 2020 đến nay, theo yêu cầu sô : 6373/TCHQ-TXNK, Hải Quan cửa Khẩu Cất Lái đổi mã HS sản phẩm SEASONING LAVER: 200899.
Do vậy Công ty đã không xác định được chính xác tiêu chi xuất xứ hàng hóa tại thời
điểm nhập khẩu, Trên C/O form E vẫn được ghi là WO.
Nhưng theo phụ lục 1, thông tư 12/ 12/2019/TT-BCT thì mã HS : 200899 có tiêu chi
xuât xú là : RCV XX% hoặc CC
Bằng công văn này, Công ty rất mong Chi cục Hải Quan xem xét, và có văn bản hướng
dẫn cách ghi ở ô 8 trên C/O form E. Vói những C/O form E đã ghi tiêu chi Là WO có được chấp nhận không.?
